Samenvatting Leading figures from South Africa and Zimbabwe’s legal profession and civil society have told IBA that the 31 March poll in Zimbabwe cannot be free and fair. Their analysis of the legal framework for Zimbabwe’s election is contained in this publication. Among the reasons cited were:
  • sweeping presidential powers;
  • the use of highly repressive laws (The Public Order and Security Act and Access to Information and Protection of Privacy Act);
  • the existence of partisan electoral institutions;
  • a military presence in key electoral institutions;
  • a compromised judiciary;
  • legal restraints on independent voter education;
  • an entrenched culture of impunity within the ruling party; and
  • the use of laws disenfranchising almost 50 per cent of the country’s eligible voters.
